Halle Berry filed on October 6 asking a court to restore custody of her 12-year-old son, Maceo, calling reports of abuse allegations misleading. The judge allowed Maceo to testify against his mother, and on October 21 a middle school administrator testified the boy never told him his mother choked him. On October 24 Berry's lawyer confronted Martinez with a 2024 sworn declaration stating no history of domestic violence between them. On October 30 the judge denied Martinez's restraining order and dissolved the TRO, but Berry still gets no overnight visits. Another hearing is scheduled for November to review the custody arrangement, and no final custody ruling has been issued.
